Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the services provided by AdProtektor Inc. (“AdProtektor,” “we,” “us,” or “our”), including our website at adprotektor.app, our application at app.adprotektor.app, and all related tools, scripts, and APIs (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

AdProtektor provides AI-powered click fraud detection and prevention for digital advertising. The Service includes:

• A tracking script for deployment on your websites to monitor and analyze visitor behavior
• AI-based visitor classification and threat scoring
• Automated IP blocking and visitor exclusion
• Session recording for verification of flagged activity
• Google Ads integration for automated IP exclusion list management
• Meta (Facebook / Instagram) Ads integration for automated Custom Audience exclusion management
• Analytics, reporting, and dashboard tools

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at support@adprotektor.app if you become aware of any unauthorized use of your account.

4. Free Trial

We may offer a free trial period (currently 3 days on Standard and Pro plans). During the free trial, you have access to the features included in the applicable plan. At the end of the trial period, your subscription will begin and you will be charged unless you cancel before the trial ends.

We reserve the right to modify or discontinue free trial offers at any time without notice.

5. Subscription Plans and Pricing

The Service is offered under tiered subscription plans (Standard, Pro, and Enterprise), each with different features, domain limits, and click allowances. Current pricing is displayed on our website and may vary based on the billing cycle you select (monthly or yearly).

We reserve the right to change our pricing at any time. If we change the pricing of your current plan, we will provide at least 30 days’ notice before the new pricing takes effect. Your continued use of the Service after the pricing change constitutes acceptance of the new pricing.

6. Payment Terms

• All payments are processed securely through our third-party payment provider.
• Subscriptions are billed in advance on a recurring basis (monthly or yearly, based on your selected plan).
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• If a payment fails, we may suspend or restrict access to the Service until the payment issue is resolved.
• All fees are exclusive of applicable taxes, which will be added where required by law.

7. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• You will not be charged for subsequent billing periods.
• We do not provide prorated refunds for partial billing periods.

8. Tracking Script and Data Collection

The Service requires you to install a tracking script on your website(s). By using the Service, you represent and warrant that:

• You have the legal authority to install tracking scripts on the websites you register with AdProtektor.
• You have a lawful basis under applicable data protection laws (including GDPR, where applicable) for the data collection performed by the tracking script.
• Your website’s privacy policy adequately discloses the use of fraud detection services, behavioral tracking, session recording, and any cookies or similar technologies used by the Service.
• Where required by law, you obtain appropriate consent from your website visitors for the data collection and processing performed by the tracking script.

AdProtektor acts as a data processor when processing data collected from your website visitors. The terms governing this processing are set out in our Data Processing Agreement.

8.1 ConversionOS (Optional Paid Add-on)

ConversionOS is an optional, separately-priced add-on. If you enable it for a domain, you instruct and authorize AdProtektor to receive conversion events from that domain — including hashed customer identifiers — and to dispatch those events on your behalf to the third-party destinations you configure (Meta Pixel + Conversions API, Google Analytics 4, and/or Google Enhanced Conversions for Web). You represent and warrant that you have a lawful basis under applicable data protection laws to share each such conversion event with each destination you select, and that your privacy notices to visitors adequately disclose this sharing. You can disable ConversionOS, change destinations, or rotate the per-domain site key at any time from the application.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Access the Service in order to build a competitive product or service
• Use the Service to harass, stalk, or infringe upon the rights of others
• Share your account credentials with unauthorized third parties
• Exceed the click or domain limits of your subscription plan through artificial means

10. Intellectual Property

The Service, including all software, algorithms, AI models, user interfaces, documentation, and content, is owned by AdProtektor Inc. and is protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of your data. By using the Service, you grant AdProtektor a license to process your data solely as necessary to provide the Service.

11. AI-Based Decisions

The Service uses artificial intelligence to classify visitors and make blocking decisions. While our AI is designed to be highly accurate, automated decisions may occasionally result in misclassification of legitimate traffic or failure to detect fraudulent traffic.

You can review all AI decisions through the dashboard, whitelist any visitor, and override automated blocking rules. AdProtektor is not liable for any losses resulting from AI-based classification decisions.

12. Service Availability

We use commercially reasonable efforts to ensure the Service is available and operational. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• AdProtektor’s total liability arising out of or in connection with these Terms or the Service is limited to the amounts you paid to AdProtektor in the 12 months preceding the claim.
• AdProtektor is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, even if we have been advised of the possibility of such damages.
• AdProtektor is not liable for losses resulting from fraudulent clicks that the Service failed to detect, or from legitimate traffic that was incorrectly blocked.

14. Indemnification

You agree to indemnify, defend, and hold harmless AdProtektor Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your failure to obtain required consents or provide required privacy notices in connection with the tracking script
• Your violation of any applicable law or the rights of any third party

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
